PROSECUTORIAL OVERSIGHT OF NON-CUSTODIAL SENTENCES: NATIONAL AND INTERNATIONAL EXPERIENCE

The article analyzes the national and international legal foundations of prosecutorial supervision over the activities of institutions and bodies responsible for the execution of criminal penalties, with particular emphasis on probation services. It substantiates that the essence of the supervision institution lies in the objective assessment of legality and public order during the execution of sentences, the prevention and elimination of violations, as well as the protection of the rights and freedoms of convicted persons. The paper examines the principles of external and internal monitoring, independent oversight, humane treatment, rehabilitation, and reintegration as enshrined in the UN Nelson Mandela Rules, the Tokyo Rules, the Bangkok Rules, and the revised European Prison Rules. In addition, the subject matter, powers, and organizational mechanisms of prosecutorial supervision established in national legislation are comprehensively addressed.
